Default Move Over Lexus VW Parks Itself Too

Still don't trust a car that parks itself anymore than I do a waterless wipeless toilet stall, but looks like VW has jumped on the self-parking concept with the new Touran model coming out

So who's to blame the first time one of these cars malfunctions and damages another car?

Lexus has made it very clear it requires the driver to verify the clearance before allowing it to proceed. I've not witnessed it in person, but it would be an act of the driver. It's like installing ESP and having it diabled by default, you can't sue the car company if it clearly stated in the manual that the EPS must be manually turned on. I bet there is an entire page or two of warnings about the auto parking feature in the book, all the legality that Toyota/Lexus needs to escape an impending lawsuit from a less than alert driver.
